Terms and Conditions

1. Who I am and what these terms cover

These terms apply when you buy a 1-on-1 mentorship program or a Frame Teardown from me, when you use my free resources or receive my emails, and when you use gedaskevicius.com. Sections 1 to 7 apply to everything. Sections 8 to 12 cover each service. Sections 13 to 15 cover your rights and the fine print.

Who “I” and “you” are. “I”, “me” and “my” mean Vizualiniai Sprendimai, MB, the Lithuanian company through which Gediminas Daškevičius provides his services. Where these terms talk about illness, availability or how you treat me, “I” and “me” also mean Gediminas Daškevičius personally. “You” means the person who buys or uses a service.

Who can buy. You must be at least 18.

Consumers and businesses. You’re a consumer if you buy mainly for personal purposes rather than for a business. Some parts of these terms apply only to consumers, and they say so. If you buy as a consumer, nothing in these terms limits the rights consumer law gives you.

Buying for a business. If you give a company name or VAT number at checkout, you confirm that you’re buying for your business. A business must pay the full price without deducting any withholding tax. If a business buys a place for someone else, it must make sure that person follows these terms.

2. How buying works

  1. On the offer page, you choose a payment option. The offer page shows the price, the payment options, the dates and what’s included.
  2. You pay through Stripe’s checkout. Before you pay, you can review and correct your details, and you must confirm that you accept these terms.
  3. After you pay, Stripe emails you a receipt. The receipt only confirms your payment.
  4. Within 1 working day, I send you a confirmation email with the date of our contract, what you bought, and PDFs of these terms and of the offer page. Our contract is concluded on the date stated in that email. If you haven’t received it within 2 working days, check your spam folder and contact me.

Declining a purchase. Before I send the confirmation email, I may decline a purchase, for example if all places are already taken. If I do, I refund your payment in full within 14 days, and no contract is concluded.

Price errors. If a price on my site is obviously wrong, I’ll tell you before sending the confirmation email. You can then pay the correct price or get a full refund.

What makes up our agreement. Our agreement consists of my confirmation email, these terms, and these details from the offer page as it was when you paid: the price, the payment options, the dates, the program’s length and the list of what’s included. If they disagree, those offer page details come first, then my confirmation email, then these terms. If my confirmation email is better for you than the offer page, the email applies. I keep a copy of our contract and will send it again if you ask.

Language. The contract is in English. Any other translation is for convenience only, and the English version applies.

3. Prices, VAT and payment

  • Which price applies. If you live in the EU, you pay the euro price, which includes VAT. If you live outside the EU, you pay the US dollar price, and no EU VAT is added. Where you live decides the price, not where your card was issued. For a business, the country where it is established decides. If you pay the wrong price, I refund it in full and send you the correct payment link. If you give me a wrong country and I have to pay extra tax as a result, you must pay me that amount.
  • Business buyers in the EU. If you buy for a business registered for VAT in an EU country other than Lithuania and enter a valid VAT number at checkout, you pay the euro price without VAT, as shown on the offer page and at checkout. My invoice says “reverse charge”, and you account for the VAT in your country. If your VAT number turns out to be invalid and I have to pay VAT as a result, you must pay me that amount.
  • Taxes outside the EU. The US dollar price doesn’t include any tax. If the law of your country requires me to charge its sales tax, VAT or GST, I’ll add it to the price and show you the total before you pay. If you buy as a business, you must pay any tax your country charges you for buying services from abroad.
  • Your price is fixed. The price in my confirmation email doesn’t change during your program, including for payments in parts.
  • Payment. Stripe processes all payments. I never see or store your card details. You receive a receipt by email for every payment.
  • Currency. If your card is in another currency, your bank converts the amount and may charge a fee. I refund in the currency you paid in. If your bank converts a refund, it may use a different rate, and I’m not responsible for that difference.
  • Payment disputes. If you have a problem with a payment, please contact me first; it’s usually quicker. If a payment is reversed through your bank without good reason, the amount is still due, and you must pay it within 7 days of my email. During the program, “If a payment fails” in section 8 also applies. If you buy as a business, you must also pay the dispute fee my payment provider charges me.

What’s protected. The videos, articles, photos and free resources on this site, and the curriculum, documents, diagrams and recordings in my programs (“my materials”), are owned by Gediminas Daškevičius or by me, or used with permission.

What you may do. You may use what you learn from me in your own photography, including paid work for your clients. You may keep my materials for your own reference.

What you may not do. You may not copy, publish, share or sell my materials, or use them to teach others, without my written permission. This continues after your program ends.

Copyright concerns. If you believe something on my site uses your work without permission, email me the details and I’ll respond within 14 days.

5. Results and liability

What I commit to. I will deliver each service as described in my confirmation email, in the offer page’s list of what’s included and in these terms, with reasonable care and skill. I don’t promise specific results, bookings or income, because they depend on your work, your market and things outside my control.

Your part in the results. Your results depend on doing the tasks and the shoots. If you don’t do them, that isn’t a failure of my service, and it doesn’t entitle you to a refund for calls that have taken place. This doesn’t limit the fit check in section 10 or your 14-day right in section 13.

Safety at your shoots. You’re responsible for safety at your shoots, including the equipment, the studio and the people there. My advice doesn’t replace the studio’s rules or the equipment manufacturer’s instructions.

Limits of my liability. I’m not liable for losses that weren’t reasonably foreseeable when we made our contract, or for losses caused by your shoots, equipment, studios or the people you work with, unless my advice caused them. My total liability to you for a service is limited to the full price of that service. If you buy as a business, I’m also not liable for lost profit, lost income or lost clients.

What these limits don’t cover. They don’t apply to death, injury or harm to health, to non-pecuniary damage, to losses I cause intentionally or through gross negligence, or to anything else the law doesn’t allow me to limit.

Calls take place on Google Meet or comparable video software, and payments go through Stripe. My site also links to other websites and software. These companies have their own terms and privacy policies, and I’m not responsible for their services or content.

If a call is interrupted by a problem with my connection or equipment, or by an outage of the video service itself, I’ll make up the lost time. If it’s interrupted by a problem with your connection, device or setup, the call still ends at its scheduled time. If it’s interrupted by an event under “Events outside our control” in section 15, at either end, we move the lost time as that clause says.

What you need for calls. You must have a computer with a working camera and microphone, a stable internet connection, a current browser or the Google Meet app, and a way to send me full-resolution files. Please test your setup before our first call.

7. Privacy and confidentiality

Personal data. How I collect and use personal data is explained in the Privacy Policy.

Confidentiality. I keep private what you share with me about your work, clients and business, unless you agree otherwise or the law requires me to disclose it. I may talk about general lessons from our work in my content, without anything that identifies you, your clients or your images. Section 9 covers your images.

8. Mentorship programs: what you get and how you pay

What’s included. Each program’s offer page sets out what’s included, such as the number and length of the calls, the shoots and the feedback.

Weeks. Week 1 starts on the day of your first call. Each week is 7 days.

Program period. The program period starts on the day of your first call and lasts one week longer than the program length shown on its offer page. It gives us room to move calls when needed.

Dates and your weekly slot. Each intake has a limited number of places, and the offer page shows its start date. Before the start date, we agree in writing on a fixed weekly day and time for your call, Monday to Friday, between 06:00 and 19:00 GMT. If we can’t agree on a slot before the start date, either of us may cancel, and I refund everything you’ve paid. If I have to move the intake’s start date, you can accept the new date or get a full refund.

Who delivers it. Gediminas Daškevičius delivers your mentorship personally, and no one else will. Your place is personal: you may transfer it to someone else only with my written agreement, before the program starts.

Program price. “Program price” means the total you pay for the payment option you chose, as stated in my confirmation email, after any Frame Teardown credit.

Paying in parts. If you choose to pay in parts, the amounts and due dates are shown on the offer page and in your confirmation email. The first part is charged at checkout, and the others fall due before later weeks of the program. If the start date moves or the program pauses, the later due dates move with it. At checkout, you authorize Stripe to charge your card automatically on each due date, and you get a reminder email at least 3 days before each charge.

If a payment fails. I’ll email you, and you have 7 days from that email to pay. Calls go ahead as planned during those 7 days. If the payment is still missing after 7 days, calls stop until you pay, and I may end the mentorship under section 10. A call missed because a payment was more than 7 days late counts as taken.

9. Mentorship programs: calls, messages and your part

Calls

  • Call times. Each call takes place at the time in my calendar invitation, set in Lithuanian time, including when clocks change on different dates in your country.
  • Who attends. Only you may attend the calls, unless I agree otherwise in writing. You may not share the call link or let anyone else watch or listen.
  • Moving a call. If you tell me at least 72 hours before a call, I’ll offer you at least two other times in the same week or the following week, within the program period. You may move up to 3 calls this way.
  • One short-notice move. Once during the program, you may move a call at shorter notice because of illness or an emergency. This doesn’t count toward your 3 moves.
  • Lateness. If you join late, the call still ends at its scheduled time.
  • Calls that count as taken. A call never counts as taken if it’s missed because of me or because of an event under “Events outside our control” in section 15. Otherwise, it counts as taken if:
    • you cancel it less than 72 hours before it starts, or miss it without telling me, apart from your one short-notice move;
    • you’ve asked to move it, you can’t take any time I offer, and no free slot is left within the program period;
    • you ask to move it after you’ve used your 3 moves, and we can’t find another time within the program period;
    • it’s missed because a payment was more than 7 days late (section 8); or
    • you haven’t joined within 30 minutes of the start and haven’t told me you’re coming.
  • If I move a call. I’ll tell you as early as I can and offer a new time within the program period. You don’t lose the call. If we can’t find a time within it, the program period is extended for that call.
  • The program period. All calls must take place within the program period. Calls not taken by then for reasons on your side, other than an event under “Events outside our control” in section 15, expire and aren’t refunded.

Messages. You can message me by email or WhatsApp from your first call until the end of the program period, or until our last call if that’s later. If I add another channel, such as a community platform, I’ll tell you in writing. I reply within 24 hours on working days. Messages are for questions about your tasks and shoots, not for live help during a shoot.

Recordings. I may record our calls so you can rewatch them, unless you tell me not to. You can tell me at any time, including during a call, and I’ll stop recording from then on and delete earlier recordings if you ask. Recordings are an extra, not part of what’s included: if a recording fails or isn’t made, that doesn’t affect the program. I share each recording only with you. You may download it and keep it for your own reference under section 4. I keep my copies no longer than 6 months after the program ends, unless a dispute about the program needs them, and I may delete them sooner. You may not record calls yourself.

Your part

  • Attendance and tasks. The program works only if you attend the calls and do the tasks. If you don’t, you’re not entitled to extra calls or a refund, except as sections 10 and 13 provide.
  • Shoot costs. You arrange and pay for everything your shoots need, including the studio, the model, and hair and makeup if you choose it. You also need the equipment and software listed on the offer page.
  • Your shoots. I’m not present at your shoots. You’re responsible for the studio, the equipment, the people you work with, and for getting the permissions and model releases you need, including permission to send me the images for feedback.
  • What you send me. You must only send me images you have the right to share with me, and never images that are illegal to share. Before sending images of children, or nude or intimate images, you must have the written consent of the people shown (for a child, of a parent). I may refuse to review any image. If you break these rules and someone makes a justified claim against me as a result, you must pay my reasonable resulting costs.

Shoot bookings. You book and pay for your shoots directly with studios, models and other providers. Book with free cancellation where it’s offered, and don’t pay for bookings you can’t cancel before the fit check ends. Your bookings are separate from the program: they stay yours and you can still use them if the mentorship ends, so ending the mentorship doesn’t make them a loss I pay for.

Your images and words. Your images stay yours. I use them only to deliver your program, and I delete them no later than 30 days after our last call, or when a dispute about the program is resolved, if later. I don’t publish or show your images, your name or what you tell me to anyone without your written permission. I use service providers to deliver the program, such as video calls, file storage and AI tools. My Privacy Policy explains which ones I use and how each handles your files. If you give permission for a testimonial or a before-and-after, you can withdraw it at any time. I’ll then stop using it in anything new straight away, remove it from my website, emails and social media within 14 days, and cut or blur it out of published videos within 30 days.

10. Mentorship programs: fit check and ending early

Before your first call. You may end the mentorship by email at any time before your first call. I refund everything you’ve paid for the program within 14 days of your message and cancel any remaining payments.

Fit check (14-day money-back guarantee). The fit check covers the first 14 days of the program, counting the day of your first call as day 1. It ends at 23:59 Lithuanian time on day 14 and applies once per person. Either of us may end the mentorship by email during the fit check. If you end it, I refund everything you’ve paid for the program. If I end it, I tell you why and refund everything you’ve paid for the program. In both cases I refund within 14 days, cancel any remaining payments and deduct no compensation, whatever the reason for the ending. The fit check covers the program price, not a Frame Teardown, which is a separate, completed service.

Ending the mentorship yourself. After the fit check, you may end the mentorship at any time by email. It’s settled as described in “How every early ending is settled” below, with no compensation.

If I end the mentorship because you broke these terms. After the fit check, I may end the mentorship by email if:

  • a payment is still missing 7 days after I told you it failed,
  • you threaten or harass Gediminas Daškevičius, or seriously or repeatedly insult him after he has asked you in writing to stop,
  • you copy, share or sell my materials in breach of section 4, or
  • you seriously break another part of these terms and don’t put it right within 7 days of my email asking you to.

Missing calls, not doing tasks and not doing shoots are never a breach under this paragraph. Section 9 and “If you stop doing the work” cover them. An ending under this paragraph is settled as described below, with no compensation.

If you stop doing the work. If you don’t do the tasks for two weeks in a row, or don’t do a planned shoot, I’ll remind you in writing. If you haven’t caught up 7 days after my reminder, I may end the mentorship by email. It’s settled as described below, with no compensation.

If I can’t continue. If illness or another serious reason stops Gediminas Daškevičius from holding our calls, I’ll tell you as soon as I can, and the program pauses. Any payment due during the pause moves back by the length of the pause. You then choose: we continue on later dates we agree on, beyond the program period if needed, or I end the mentorship and settle it as described below, with no compensation. If I can’t resume our calls within 8 weeks of the first call I cancel, either of us may end the mentorship on the same basis. If Gediminas Daškevičius permanently can’t deliver the program, the mentorship ends on the same basis.

How every early ending is settled. When the mentorship ends early after the fit check, for any reason, I cancel every payment not yet charged. For each call that has taken place or counts as taken, you owe the program price divided by the number of calls in the program, and never more than the program price. If you’ve paid more than you owe, I refund the difference within 14 days of the ending. If you’ve paid less, you must pay the difference within 14 days of my invoice.

Payment fees on refunds. When the mentorship ends because you ended it after the fit check, or under “If I end the mentorship because you broke these terms” or “If you stop doing the work”, I may deduct from your refund the fees my payment provider kept on the refunded amount, such as card processing and currency conversion fees. I show them on the refund. I don’t deduct them in any other case, including refunds before your first call, during the fit check, under your 14-day right in section 13, or when I can’t continue.

11. Frame Teardown

The Frame Teardown is a single video call in which we go through your images together, as described on its offer page. I delete the images you send for it 7 days after the call, unless you enroll in a mentorship program.

Recording. I may record the call so you can rewatch it, unless you tell me not to. The rules on recordings in section 9 apply, and I keep my copies no longer than 6 months after the call.

Credit toward a mentorship program. If you enroll in a mentorship program within 30 days of your Teardown call, I take the Teardown fee you paid off the program price. The Teardown stays a separate, completed service. The credit applies once per person.

Moving or canceling. You may move the call once, or cancel it for a full refund, by email at least 48 hours before it starts. If you give less notice, or don’t join within 15 minutes of the start, the call counts as held and I don’t refund it, except under the next paragraph. If I need to move the call, you choose a new time or a full refund.

Your 14-day right (consumers). If you’re a consumer, you may cancel within the 14-day period in section 13 and get a full refund, whatever the notice, as long as the call hasn’t been held. I schedule your call after that period unless you ask me in writing to hold it sooner. If you ask, you must also confirm that you understand you lose your right to cancel once the call has been held, and I’ll repeat this in my confirmation email. If you asked for an early call and don’t join within 15 minutes of the start, the call counts as held and I don’t refund it.

12. Free resources and emails

  • Free resources. My free resources, such as the moodboard template and the gear guide, are for your personal use. You may not sell, republish or share them as your own. They’re provided as they are, and I may change or remove them at any time.
  • Emails. If you subscribe to my emails, you can unsubscribe at any time with the link in every email.

13. Your right to cancel (consumers)

The 14-day right. If you buy as a consumer, you have the right to cancel the contract within 14 days without giving any reason. The period ends 14 days after the day the contract is concluded, which is the date stated in my confirmation email. If the last day is a Saturday, Sunday or a public holiday in Lithuania or in the country where you live, the period ends on the next working day. You meet the deadline if you send your message before the period ends in your own time zone.

How to cancel. Tell me your decision by a clear statement, for example an email to ge@gedaskevicius.com, a letter to Savanorių pr. 271-301, Kaunas 50131, Lithuania, or a call to +370 604 06224. You may use the form below, but you don’t have to.

Mentorship programs. If you cancel within the 14 days, I refund everything you’ve paid, even if your first call has already taken place. After the 14 days, section 10 applies.

Frame Teardown. Section 11 explains when a Teardown can no longer be canceled.

Refunds. I refund all payments I’ve received from you without undue delay and no later than 14 days after I receive your message, using the same payment method unless you expressly agree otherwise. You pay no fees for the refund.

To Vizualiniai Sprendimai, MB, Savanorių pr. 271-301, Kaunas 50131, Lithuania, ge@gedaskevicius.com:

I hereby give notice that I withdraw from my contract for the provision of the following service: [service]

Ordered on: [date]

Name: [your name]

Address: [your address]

Signature (only if you send this form on paper)

Date: [date]

14. Complaints, law and disputes

  • Complaints. Please email me first. I’ll give you a full written answer with reasons, free of charge, within 14 days of receiving your complaint.
  • Law. Lithuanian law governs these terms. If you’re a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
  • Consumer disputes. If you’re a consumer and we can’t resolve it, you may apply to the State Consumer Rights Protection Authority of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba, vvtat.lt) within one year of contacting me.
  • Courts. If you’re a consumer, you may bring a claim in the courts of Lithuania, or in the courts where you live if the law gives you that right. For business buyers, the courts of Kaunas have exclusive jurisdiction.

15. Everything else

  • Notices. We give each other notices under these terms by email. I use the address you gave at checkout, and you use ge@gedaskevicius.com. An email counts as received when it’s sent, unless the sender gets a delivery failure message. You must keep your email address up to date. For the 14-day right in section 13, you may also use post or any other clear statement.
  • Days and time. “Days” means calendar days. A “working day” is Monday to Friday, except public holidays in Lithuania. Unless these terms say otherwise, all times and deadlines are in Lithuanian time.
  • Changes. I may update these terms for future purchases. The version that applies to you is the one attached to your confirmation email.
  • Events outside our control. Neither of us is liable for a delay or failure caused by an event the affected person couldn’t control, couldn’t reasonably foresee when we made our contract, and couldn’t avoid or overcome. Examples are a regional power or internet outage, a natural disaster, war or civil unrest, an act of government, and a sudden serious illness, injury or hospital stay of you or of Gediminas Daškevičius. A problem with your own or my own equipment, software or home connection, a lack of money, and a failure by a studio, model or other supplier are not such events.
    • Notice. The affected person must tell the other as soon as possible and say what happened and how long it’s likely to last. If notice is late, this protection starts only from the notice.
    • Evidence. If asked, the affected person must give reasonable evidence. For an illness, a short note from a doctor or hospital is enough; no diagnosis is needed.
    • Limiting the effect. The affected person must do what they reasonably can to limit the effect, for example by joining from another device or connection.
    • Calls and payments. A call missed because of such an event doesn’t count as taken. We move it to a date we agree on, beyond the program period if needed, and any payment due during the event moves back by the same time.
    • Long events. If such an event stops our calls for more than 8 weeks in total, either of us may end the mentorship by email, and it’s settled as in “How every early ending is settled” in section 10, with no compensation.
    • What this doesn’t change. This doesn’t cancel a payment that’s already due, doesn’t reduce any refund these terms give you, and doesn’t limit your rights as a consumer.
  • Transfer. I may transfer our contract to another company that Gediminas Daškevičius controls, if your rights stay the same. I’ll tell you by email first.
  • Records in a dispute. If you dispute a payment or make a claim, I may keep the records, messages, recordings and images related to it until the dispute is resolved.
  • What continues after our contract ends. Section 4, the confidentiality and image rules in sections 7 and 9, the payment and refund rules in sections 3 and 10, and sections 5, 14 and 15 continue after our contract ends, however it ends.
  • If part of these terms is invalid. If a court finds a part invalid, the rest still applies.
  • Not enforcing a right. If either of us doesn’t enforce a right straight away, we haven’t given it up.
  • Contact. ge@gedaskevicius.com, +370 604 06224
